This agreement is an official and public offer by the Seller to conclude a sale and purchase agreement for the Goods presented on the website https://www.eccomoss.com (hereinafter – the “Website”). This agreement is public, meaning that according to Article 633 of the Civil Code of Ukraine, its terms are identical for all buyers regardless of their legal status (individual, legal entity, sole proprietorship) and without giving preference to one buyer over another.

By concluding this Agreement, the Buyer fully accepts the terms and procedure for placing an order, paying for the goods, delivering the goods, returning the goods, and all other provisions of the agreement.

1.  DEFINITIONS

  • Public Offer (hereinafter – the “Offer”) – a public offer made by the Seller to an indefinite number of persons to enter into a remote sale and purchase agreement (hereinafter – the “Agreement”) under the terms specified in this Offer.

2.  SUBJECT OF THE AGREEMENT

  • The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods (if the Buyer is also the Recipient) under the terms of this Agreement.

3.  ORDER PLACEMENT

4.  PRICE OF GOODS AND SERVICES

    • Upon receiving the Goods, the Buyer must check their conformity with qualitative and quantitative characteristics (product name, quantity, completeness) in the presence of the delivery service representative. If the Buyer is not the Recipient, the Recipient shall perform this check.
    • By signing the delivery note, the Buyer or the Recipient confirms that there are no claims regarding quantity, appearance, or completeness of the Goods.

  • CPT (Carriage Paid To) — Seller pays for transport to the destination point, but risk passes when the Goods are handed over to the carrier.

The final delivery term, carrier, and delivery service (including DHL, UPS, FedEx, Nova Poshta Global, Meest Express, etc.) shall be agreed upon by the Parties.

  • The Seller reserves the right to adjust the price of the Goods and/or delivery prior to order confirmation in case of currency fluctuations, carrier tariff changes, customs fees, etc.

5.  RIGHTS AND OBLIGATIONS OF THE PARTIES

6.  RETURNS

7. DELIVERY TERMS

  • Change of delivery time or address by the Recipient;
  • Refusal of the Recipient to accept the Goods;

8.  LIABILITY
